No, it is brand new. Got it at Best Buy Sunday. I also have an uneven screen temperature which makes reading things with white background a bit annoying. I think I'm going to go back and exchange it tomorrow.

Wow. Sounds like you got a dud. That's definitely something I would do an exchange for.

What battery app is that? Could be its algorithms are off?? (doesn't look like the display I get on Mavericks).

As the machine is new is Spotlight running? You should check what cpu usage is on the activity monitor, if an app is using cpu, its using energy and that will help you tell if the battery drain is "real" or not.
