And all along I thought the ads were trying to sell--excuse me, temporarily sublicense--music!

I thought the final line or two of the story said a mouthful:

"(The BuyMusic.com ads) are pure stealing," wrote starman, a MacNN forum poster. "Ironic, isn't it? It's what the music store is trying to keep people from doing -- stealing."

I don't see why people think that Buymusic isn't copying apple's ideas and expressions. If the same people were in both ads, the only differences would be the mp3 player and the fact that it says buymusic at the end of the commercial. I don't see how exactly copying one of Apple's ads is a form of homage. It is, however, stealing and copyright infringement, IMO.
