Terminating a $399/$499 iphone contract

if you aren't eligible for an upgrade and pay $399 for the iphone do you get to keep it if you terminate your contract before the first 30 days?

Er, well, if you're just canceling the service, then I would suppose so.

For the $199 the equipment must be returned because the phone was subsidized by at&t. The $399 price is suppose to be unsubsidized and so it'd be a similar to the original iphone. You were not required to return the original iphone when you canceled your contract.

Yes, you will.
The $399 price is still subsidized, just less so.
Unsubsidized is $599 and $699.
