I'm finally going to buy an iPod and in fact, know of a seller who is selling a 16GB Touch for $190. It looks to be in good condition, and though orignally only expected to pay $150 for an 8GB, I think I;ll go with this one.

BUT!

In the photo's he has sent me, on the home screen with all the apps, there is a wallpaper behind them. Obviously a jailbreak and w/ the apple app store I see no reason to have a jailbroken ipod touch....so can it be restored or should i just keep looking?

Awesome. The seller just told me he can indeed restore it.

And this should automatically make me have a regular ipod touch?

When the touch was first announced I really wanted to jailbreak it if i bought one at the time...but now w/ the app store i see no need and don't want a jailbroken one.

So this should make everything fine then?

From a glance at the guide, yes. A restoration takes it right back to factory settings, allowing you to upgrade from scratch.
