how to activate iphone 3g without contact?

i am buying a iphone 3g off my brother and would like to activate it with a data plan without the 2 year contract.

is it possible?
 
Your brother's contract will continue with his SIM card.

You're free to get another AT&T SIM Card, no-contract and use it with the iPhone.
 
hes keeping his sim

but once i put my sim, i can activate through itunes without a 2 year contract?
 
The only time you ever sign a contract is when you buy a discounted phone from AT&T. Since you bought the phone off someone else, you don't have to have a contract. Only if you bought the phone brand new.
