Handbrake FPS Average Varies (largely)?

I have a few questions in regards to encoding blu ray with Handbrake. I've noticed with some blurays my CPUs are maxed out and I'm getting around 26fps average, then others my CPUS are around 60% and I'm only getting 12fps average?

Anybody know why this is happening?

MacPro 2008
2 x 3.2
18gb Ram
Snow Leopard
The handbrake version mentioned on the first page of the "blu RAy to apple tv thread"
