i'm michael's fans. wanna create a iphone app for memory him. however, in my plan, this app inculding some classic icons, vocal concert images. i don't know use these are legal or not. any one can help me? thx so much.🙂
another question, whether is it tortious to use the silhouette image that imitates michael jackson or the 3D actions which are made according to his dance steps in the app? 😛
Were not really copyright lawyers and thus do not want to advise you wrongly. Perhaps try a more specialised picture/ graphic design forum who deal with this problem on a daily basis.
Once you have an answer post back here your findings as Im interested now.
Such choreography is probably copy-written but, as stridemat said, we're not copyright lawyers. Start by reading this from the U.S. Copyright Office and then you probably need to contact better resources than this forum. Also, if you brand your app as some kind of Michael Jackson homage, you will need to get permission from his estate. On the flip side, if you don't mention Michael Jackson, what's going to attract users to your app?
You will be using his likeness and infringing on trademark. It is his estate's prerogotive to protect their IP rights. So, no... unless you make some kind of deal. (It's called business.)
