Cant change songs while in video game apps since patch

First I'd like to say I'm not to knowledgable about iPods so forgive me if I leave some important info out. I recently patched my iPod Touch 8GB (bought in July or so, I'm guessing it's newest version) to version 3.1.2 from an unknown version. When I start a video game app, it stops my podcast. I use to be able to double tab the button and start it back up. Since I updated my iPod however I cannot bring that menu up any more, it takes me to my homepage or what ever it's called.

I'd appreciate any help, thanks.
