How fast does Apple upgrade stock firmware?

I have found a crack in my housing at the ringer switch and want to go get a warrante replacement. My concern of course is getting a newer replacement with the newer baseband. Thing I have a chance of getting one that hasnt been upgraded yet?
 
I just got a white box replacement on Saturday and it came w/ 3.1.3 out of the box🙁

I'm going back again today since the new one has the wifi issues, hopefully I get 3.1.2 again
