iPod touch Fluctuating Battery

Is it normal for the battery to fluctuate with use?

ie - I turn it on, its 3 1/4 full, after a few minutes it goes upto full, then goes down to under 3 1/4 etc...

Its a 3rd gen bought 3 weeks ago.

Guess not...

Just to update, i've requested a service from Apple and they are sending me packaging to send the iPod in.

I have the same problems. First with my iPod Touch 2G and now also with my iPod Touch 3G.

Is that it? If so then why is it a big problem?
