Apple, Big Apple feud over logos

    Wow... That looks absolutely nothing like the Apple logo (it's also pretty effin' ugly). I wonder what the big deal is.

    The problem is that the way trademark law works if they don't make a stink any time someone comes close then they will lose their right to the trademark completely (IE: it becomes considered "generic")

    It's important to note that color is not a part of the trademark application, so what they're really applying for a trademark on is this:

    It looks a bit more like Apple's logo, but not really all that similar.

    You mean, aesthetically? It always looks to me like a squinting face with red and green hair parted in the middle.

    Apple is right

    I must say that I agree with Apple on this one. The shape of the NYC logo is clearly inspired by Apple's logo. Look at the leaf, same angle, almost identical shape, same proportions, and also hanging free from the rest of the logo. Come on logo makers, if you had not seen Apple's logo in your life, you would not have come up with that leaf on your own. The NYC logo is meant to be on all sorts of merchandize, meaning that it will surely be seen mirrorized (through glasses, as decals on windows etc). Waving from a flag or seen at a distance, it will not be very different from the Apple logo. The pringle-pattern is not enough, and as the guys said above, the colors are not important for the trademark issue.

    The NYC logo should at least have another leaf, or why not a piece of stalk, or two leaves?

    well i can actually see a small simularity in the outline of NYC's that's Exactly like Apples. I dont know if this would hold up in court but it is close...

    It confused me.

    I went out to get a new Mac earlier today and it wasn't until I got back home that I realised I had bought New York City.

    I suppose I should have noticed the size of the box was a little oversized for a Mac mini.

    Did it come with the Brooklyn Bridge? Never buy New York City if it doesn't come with the bridge. That's my policy anyway.

    This is just apple making sure that the "Apple" brand is not commoditized. They have to do this or they risk their trademark being invalidated in the future.

    Wow, that's pathetic. Looks like the "designer" took the Apple logo and modified it slightly. Talk about lazy.

    Of course not. But if I understand it correctly, the trademark law not only gives the holder the right to defend the trademark in court. It also requires that the holder defends it, aggressively. In other words, if Apple decides not to defend it in this particular case, it automatically opens it up for let's say MacRumors to make a logo more like Apple's. This is because any 3rd party can point to this case and, rightfully, claim that Apple has stopped defending it.

    The logos are fairly similar. Show the NYC logo to someone who is 15 ft away and ask which company, product or organization it makes him or her think of...

    Of course nobody will mix up a city and the mothership. But the NYC logo is close enough to trigger a legal defense. I'm sure the lawsuit does not come as a surprise to the NYC campaign.
