I was reading though archived news Papers, and I saw in the second page of a News Paper from South Bend (Indiana, USA) from 2002. And, I saw that a 15 year old male was arrested for having child porn (now of course the porn was of other kids his age I am sure) on his computer. The local police were tipped off by another student from the child's school, who knew of this. I think he was only facing 6 month of a detention center. I really didn't know what to think, should this have happened? Is this right??

How do you know they were kids his own age? Having relatives that actually investigate these crimes it is really hard to id someone's age who is 15, 16, 17, they all kinda jell together and can easily look 18. But if its obvious when they are say 8 years old, then its easy to charge someone. If they were of people at his school then they know that the material was underage as they have the subject of the pictures for proof of when they were born.

I think what he's asking is "is it right to charge a minor with a crime simply because he's attracted to other minors?"

If that's the question, the answer is a resounding hell no. The people that charged him need to wake up...I mean, kids aren't really supposed to lust after adults...

You're both kidding, right? He has child porn on his computer, so whether he enjoys it or not isn't an issue regarding whether this is right or wrong. The point is that children are being filmed or photographed nude so that people can get their jollies at nude underage'ers. The whole point of have anti child pornography laws is to protect kids from this sort of thing, regardless of who happens to have it on their computer.

Don't forget either that there's a decent chance the children in the pictures that our young friend downloaded were forced to pose against their will. Whether or not they were the same age as him is not the point – these aren't the sort of images anyone should be collecting. They're illegal, and with very good reason.

If she was under 18 I imagine that she would not legally be able to give permission for the filming and it would be illegal. If she is 18 but he is under 18 if he films himself with her he might well be guilty still of producing child porn.

It the simple fact of the child porn, not the age of the kid who had it.

Without knowing all the facts here, we can't comment or make sarcastic comments about joking around with his own age group.

I'd say it was unlikely that the police would charge him for having pictures of his peers on his computer unless the person who the pictures were of, or their parents, complained.

Distasteful as it may seem, and unlikely to those of us not that way inclined, it very well might have been pictures of younger children. But perhaps he escaped a heavy sentence using his youth as a defense and pleading curiosity?

They might have just had an account on MySpace, BuddyPic, or another such profile site and found others on the site who were not forced to do the photos but did them on their own.

Okay, sorry about responding late, I've been busy... I don't support anyone having Child Pornography of any kind willingly or non-willingly but. The case presented the possibility in my head, We put 18 as the age - however I have heard that many teens (Under 18) do access sites for mature adults. The only difference from those kids, he got caught. Now I don't like speculating the other peoples ages in the first post, but I just thought that if you are 15 you'd look at people about your age right?? Plus I don't think it would be the same as an adult possessing child porn, this is a child possessing child porn, would it be worse if he had people over 18 (This being sarcastic)? This is one of those cases that its hard to decided what to do... I will however go back to the Library and see if I can print and scan the article for you all, and see if there was any followup.

The kid is looking at issues later on if he's already downloading pornography at that age. Kids these days... :(

And I agree with the above posters. Doesn't matter who has it. Unless some spyware app downloaded it on to his computer without him knowing, he's still downloading illegal pornography (which is illegal for a very good reason).

And if the spyware did it, he should have been using a Mac :p
