    But then it would be a violation of eBay's terms of service. Something has to exchange hands for it to follow eBay's TOS. Still though, is this legal, from Pepsi/Apple's viewpoint?

    Umm... total cost with shipping is $10.50... those songs are worth 10 x $0.99, = $9.90

    If that were true, you wouldn't be allowed to sell virtual items, like in Ever Quest.

    I'm pretty sure what you are referring to is if you want ebay's insurance protection, etc.

    You mean to say, he's making 60 cents profit....AND YET ISN'T BEING TAXED ON IT?!?!!?!?!?!!?!? What scandal!!!!

    So someone will be able to buy songs from the itunes store without a credit card(or glue the caps to his forehead, who on earth cares)... very honest of them to go through that effort, instead of just downloading it form kazaa..

    I remember when people were trying to sell their souls on eBay. eBay closed the auctions on the grounds that nothing was changing hands. I'm pretty sure something physical needs to be transacted for it to be considered legit on eBay.

    Don't you need to put in your credit card to use the songs you won? I know I had to sign up for an account before I could redeem mine... and I had to put in a CC #.

    i cant believe anyone is falling for this, its a total rip off, and whats to stop the guy from using the codes....

    It has to be for a "legitimate item or service", which these caps kind of fall into. there's a lot of room for interpretation. I think in this case, at least allowing the person to opt to receive the codes by email...

    I think selling iTunes codes (even by e-mail) is a far cry from selling one's soul.

    we say the same thing about australia when it comes to duck-billed platypi and kangaroos. now, honestly, is a no-talent, asian, civil-engineering singer/songwriter as weird as a kangaroo? I think not.

    Possibly, I actually have no idea... but considering how many customers the itunes music store has, I'm sure there are at least a few that are under circumstances that leave them with an activated account but no chargable credit card; in such a case, I dont think 60 cents is really a big deal. In any case(even if the buying thinks these caps are cheaper than the actual songs), 60 cents isn't a big deal.

    I was wondering why he was giving away these songs then I saw: "do not call me because im hearing impaired please email me thank you regan."

    If people are dumb enough to buy it, I see no problem.

    I didn't think you could use iTunes in Europe yet... do they check where your IP is from, etc?

    they do check IPs but that only brings up a warning. If you create an american AOL account then you can buy stuff from iTMS from the UK with that so i can't see that it'd make a difference with the pepsi codes on an american account.

    I think they both hope for wider media attention. I don't think pepsi cares about this its only a blip in redemption rates. Apple was quite happy with people ebaying the songs themselves until Ebay put the kibosh on it. They weren't sure how to do the transfer but they had no issue with the concept.
