    eBay should ABSOLUTELY crack down on this sort of thing... and anyone selling an iPod or other digital storage device preloaded with copyrighted content should have their eBay account terminated and all their feedback revoked permanently.

    Agreed in principle, and you do see people flogging computers loaded with OSs no discs, and racks of apps on it, but the fundamental difference is they are not new products, don't command a price premium and obviously aren't as crook as the example under discussion.
    Incidentally, eBay do it with software, they can get it withdrawn under "Vero" and all it takes is somebody to inform them and they withdraw the listing, and notify all the watching members/purchasers
