Seems unclear from the article, was this a AirBNB rental situation? Not that that is justified, it just makes the rental illegal.
New York Times said:
Mr. Okafor says he has lived in the building, a four-story walk-up on First Avenue near 74th Street, since last year.
The apartment is his permanent residence. The old man seems to have made it his business to patrol the lobby for people that he doesn't approve of.

Literally says in the article that he has been subletting the apartment since last December.
