America was already at war with al-Qaida by 9/11, Guantanamo judge rules

    This decision doesn't give me the warm and fuzzies

    The article does list some dates that could serve as an opening of hostilities but they're all dates that could justify the judges ruling. I get the reasons the military wants to try these guys but to pull the hokey excuse that we were already at war is a no-go.

    The Guantanamo “justice” system has been a sick joke since day one. This is just further confirmation that Congress for decades has been derelict in its war powers duties. The country is officially in perpetual war hidden behind a sham legal mechanism.

    Don’t really have much sympathy for terrorists, hopefully they get water boarded and force fed bacon daily.

    His ruling isn't wrong. Technically. AQ began attacking the US in one form or another beginning in '92. The issue at present was when CIA assets were put on the ground in the days following 9/11 versus the actual date. AQ was in our sights for nearly a decade when the second WTC attack happened and the other hijackings of that infamous day.

    And hypothetically speaking, sensory deprivation torture works better than physical. The body is strong while the mind is weak.
