My wife got me a 27" iMac for Christmas & I love it. That said, she also got iWork '09, but I simply don't use it (& honestly, don't want to learn the differences between it & MO). I'd like to sell my copy for whatever I can get & buy MO.

I'm going to get MO either way, but I'm kind of frugal in a sense that I don't like owning things I never use if there's a market for it. First of all, is this even legal (for me to sell it)?

I realize this may be a very dumb question, LOL, but I'm curious. Any info would be greatly appreciated.

If it is unopened then return it to the Apple store and get your money back. If it is opened and used then you can't sell it. iWork comes with one license unless you get the family pack.

Thanks, guys.

I've opened it & installed it. That's why I thought it might be a dumb question. :) Obviously, it's not a big deal, but any recourse at all or does it just go unused?

Why not uninstall it if you aren't going to use it?

I don't see why not. There are much more questionable things sold everyday.

Yes that would be fine, legally and ethically.

I don't believe this is true, once a license is used you cannot use if again, legally. Since iWork doesn't use keys or something you can install it on many computers but it is illegal. I don't think just uninstalling if makes it free to the market again.

As a software developer I fundamentally disagree. Many software companies agree with me. For example Adobe.

You can sell second hand Apple software as long as it's uninstalled. I recently bought Logic Express from a major UK high street retailer which specialises in used tech gear and they only sell legit stuff.

This is from the legal page for Logic Studio...

http://www.apple.com/legal/sla/

And for Logic Studio the EULA says:

"3. Transfer. You may not rent, lease, lend or sublicense the Apple Software. You may, however, make a one-time permanent transfer of all of your license rights to the Apple Software to another party, provided that: (a) the transfer must include all of the Apple Software, including all its component parts, original media, printed materials and this License; (b) you do not retain any copies of the Apple Software, full or partial, including copies stored on a computer or other storage device; and (c) the party receiving the Apple Software reads and agrees to accept the terms and conditions of this License. You may not rent, lease, lend, redistribute, sublicense or transfer any Apple Software that has been modified or replaced under Section 2C above. All components of the Apple Software are provided as part of a bundle and may not be separated from the bundle and distributed as standalone applications.

"Updates: If an Apple Software update completely replaces (full install) a previously licensed version of the Apple Software, you may not use both versions of the Apple Software at the same time nor may you transfer them separately.

"NFR (Not for Resale) Copies: Notwithstanding other sections of this License, Apple Software labeled or otherwise provided to you on a promotional basis may only be used for demonstration, testing and evaluation purposes and may not be resold or transferred.

"Academic Copies: If the Apple Software retail package is labeled "Academic Single User", you must be an Eligible Educational End User to use the Apple Software. "Eligible Educational End Users" means students, faculty, staff and administration attending and/or working at an educational institutional facility (i.e., college campus, public or private K-12 schools)." "

There are also similar conditions for iWork
