    I agree that the title is misleading (as it appears to only apply to one county), but it came directly from the article. I'll let it pick up from there.

    The bold is absolutely spot on, and one of the reasons why we are a Constitutional Republic, and not a Democracy.

    Absolutely. Judge Garcia nailed it.

    Though I'd wager that even in Florida, whose residents have a history of bad decision making ;), if put to a vote now the percentage of approval would be a lot less than 62%. A lot of minds have been changed in the past 6 years.

    This is one of those situations that I say is right to overturn because it involves the freedom and rights of the minority. And it does not harm anyone.

    Reminds me of this quote:

    Democracy is based on the majority principle. This is especially true in a country such as ours where the vast majority have been systematically denied their rights. At the same time, democracy also requires that the rights of political and other minorities be safeguarded.

    Mandela was right. Glad to see this judge agrees and made the right call.

    There are two more decisions in Florida still being waited on that can come out any second. One is a US district court and will apply to the whole state. Any second now....

    According to the 1PM PT NPR news bump, the Florida AG is going to appeal the ruling.

    I guess he will have to appeal the upcoming district court ruling separately....

    Its good to see that some judges still understand the principles the USA were founded upon.
