Homeowner to gas firm: "Get off my land."

    Constitution Pipeline consortium’s surveyors were going to clear-cut a 700x50’ swath from a town road to a creek on a guy's property to figure out how to lay 30” gas pipe under protected wetlands. They don’t have the final pipeline project water regulations waivers yet from the state, but hey. Nibble at the edges, maybe state caves in...

    Property owner said no way and finally got state AND federal regulators to say no way. Outfit says to the local paper that they have “rescheduled” the work for later on. But they were just going to DO it. The guy lives downstate and only found out ahead of the tree cutting operation because a neighbor saw preparations for it, inquired and started the intervention.

    2. It does bring up the question of how his personal desires will impact the community (and their energy needs) as a whole. It's not clear whether this project is necessary and needed or not. And it's also unclear how well it was planned for and discussed throughout the community.

    So while it feels like we should root for the old guy, I can't cheer his actions without more information.

    I think the bigger beef is that they apparently came onto his property to start their work without advising him at all. It's one thing to just come onto someone's land and start cutting down their trees. It's quite another to slip them a few million before starting the work. You want to come tear up my land, start shelling out some bucks. Now, granted, my land is currently about a 5' x 8' patch of grass, but you know...

    I'm glad the property owner was able to get it stopped since the surveyor didn't have proper permits. I wish there were consequences for it. I'll bet that at the end of the day FERC will issue the permits and unfortunately the war will have been lost.

    The article say that a pipeline surveyor told him several times that the work was going to be done, and when it was going to happen. The real issue seems to be they were trying to do the project before getting all the proper permits ... a practice I can't endorse.

    Here's what I'm trying to reconcile ... the communities need for this pipeline vs. his individual desire (as well as some environmentalists) to not run that pipeline through his property. We're culturally inclined to root for the little guy. But is it really the right position to take in this case? I still haven't figured that one out.

    Eminent Domain would allow the city to run whatever they want through his property, provided the property being granted to the state is intended specifically for public use or benefit (which a gas line would be). Though he does have to be compensated, and yes, informed, for whatever is taken from him.

    It may be a lost cause; all that’s holding up Constitution line is the DEC permits fron New York State. The health commissioner has been helpful so far, but Cuomo still wavers and I think no one is quite sure whether waivers will be issued.

    Pros: the consortium argues that it will reduce consumer costs and ensure adequate supply to northeast consumers. And provide jobs. And they have dished out about $1.6 million in local grants for whatever, whatever to grease the skids. And local industry is in favor of it. The one or two larger towns in the area around here have indicated they’d like natural gas feeds for stuff like streetlighting and draw for new industries.

    Cons: argue that this pipeline extension and six others being built to traverse Pennsylvania and New York are basically being constructed with intent to export natural gas abroad from the east coast terminals that are now being planned or are in the permit-reqesting stage.

    They of course also argue on behalf of the environment up here. I mean there are like 23 pages of maps in the application paperwork showing the proposed waterway crossings in four counties. No one really knows what the effect would be of laying 30” pipe under these streams and under (or over!) wetlands that would be traversed by the line. Most of us keep wondering about how they can lay a pipe only three or four feet down in an area where the frostline is four feet (six last year), and in an area where we have had devastating floods in 2006 and 2011, so one wonders if much of the line will actually end up elevated. Which of course presents other sets of problems.

    Well, obviously, it depends on the scenario. Yes, there will be plenty of times when the community good should win over the individual property owner's desires. But in any case, unless a project is absolutely necessary, or a property owner refuses to budge under any and all circumstances, other steps might need to be taken. In other cases, the property owner should be compensated for the loss of his property. This is especially true if it's for something like a pipeline, which could have detrimental effects down the line. Myself, if the project was something like a bike path, hiking trail, or something like that, I'd have no problem. But some big-ass gas conglomerate wants to come clear-cut my property and tear it up to run some pipe through it, show me the $$$. Better yet, pay me enough to just move.

    This property is out in the middle of BF-nowhere. If he's not willing to budge or take a settlement, someone else might. It's not like there isn't room to move around there, and that the pipe can only go in this specific place.

    FERC has already granted permissions. DEC is the holdout. NYC water supply is from here, so city lawyers may be at loggerheads with Chamber of Commerce types. The tide is turning against pipelines through here (the proposed second one to run parallel to this one has just about hit a wall of resistance even in the state legislature) but this one is probably going to make it.

    They have most of the easements and have resorted to eminent domain otherwise. I am not sure all the ED cases are resolved. That's definitely an uphill battle anyway these days.

    I still keep wondering why they did not run most of it along the right-of-way of Interstate 88. To me it's about the hope that they will still be able to frack gas in New York some day. and where they are running the pipe is the general area where this consortium and others wanted to frack. They were buying up leases like crazy the last few years. So imo if the line were just about transport, it would be half in the ground already and iti would be along the interstate to minimize their hassles with getting easements.

    Like it or not, in the northeast, most of the power generation is from gas. As I understand it, the pipelines are at capacity so need to build more pipes or move away from gas.

    NYS Department of Environmental Conservation.

    See FERC gave its permissions on the thing but they don't authorize proceeding unless the environmental considerations are worked out...

    And while I'm sympathetic to those considerations (and hope they are thoroughly examined) I have a hard time mustering up much outrage over the owners concerns that 46 year-old trees will be replaced with blades of grass. Re-plant more trees, and in a relatively short time they will be mature. We're not talking about thousand year-old old growth here.

    Actually one can't plant trees along where the easement goes. It's in the fine print somewhere. Interference with the inspection process, I think. There are a lot of restrictions; you have to get written permission to do much of anything in the easements short of mowing the grass and walking along there, can't plant shrubs and stuff...

    Yeah he's gonna have to get over it. But it does really set people's teeth on edge that the consortium was proceeding with preliminary work while the water quality waivers have not yet been issued and the project is thus not yet greenlighted.

    I'm starting to be more concerned about some of the ten-inch feeder pipes they want to lay for industry in the area. Some of them are slated to run along roads parallel to creeks that in 2006 before the floods were like 12 feet wide. In the flood they became half-mile-wlde monsters that actually ate the county roads running along them. The Army Corps of Engineers helped pick places to put massive pieces of rip rap to shore up the embankments and it has helped, but there are places along a state road the ten-inchers will follow that are under water when it floods less than in 2005, 2006, 2011. Those feeder line details are of course still on hold since the main line has not been built. Time will tell.

    Seems very strange that they were trying to cut down trees and clear the area first, without the easement being granted. Sounds like trespassing, vandalism, and theft. Does New York law allow this?

    I could be missing something, but, it doesn't sound like they are building this for transmission between point A and point B. It sounds like they are building it to support natural gas production. If that natural gas production is not currently allowed, why build all this infrastructure? Transmission lines are not hazard-free; may I assume that the path avoids being close to dwellings? Here is an rupture along a freeway in West Virginia:

    If this is true, then that changes things. A project that delivers service to a community is very different from a commercial enterprise that uses their land solely to bolster its profit. I'd be angry and dismayed to see eminent domain applied in those cases.

    At the federal level FERC has signed off on the plans for Constitution Pipeline and the rights of way apparently (mostly) secured either by consent or via eminent domain, but they cannot authorize proceeding before knowing if the state environmental conservation agency grants (or doesn't grant) a waiver of any water quality regulations after stating them and getting info on mitigation from the consortium.

    So it wasn't exactly trespassing, etc. It was jumping the damn gun and probably intentional to try to make one more wedge of "see we already went to all this trouble" as a way of pushing for the DEC approval by NYS -- sort of an addition to some materials depots they've arranged to lease or buy for now, and gotten partial permission to store stuff in, but not to coat the pipes they've stacked up there. It's about trying to make it a done deal when it's not quite done and might NOT be done if they can't get the waivers. Or from their point of view it's just trying to see if they can go ahead and solve a knotty problem ahead of time, namely how to lay pipe in this terrain. They know some of it from experience, but this line involves protected wetlands so some things have to be done differently

    No one really knows what's going to happen with gas piped through the line, since we're not 100% sure that it's jsut for transmission of existing gas production in Pennsylvania. This pipeline extension was certainly on the drawing boards before the moratorium on fracking in New York happened.

    So lots of people figured the reason for the Constitution line going through private properties in New York instead of laying pipe in existing right of way like I-88 or Route 206 or whatever, was about transporting newly fracked gas from areas in New York where they'd get leases to extract the gas. Then came all the news about new coastal terminal constructioni plans, the concerns about whether it was just going to be exported rather than used by power utilities or other consumers in the Northeast, some indications that Iroquois Gas was going to reverse part of its flow to pipe gas to coastal terminals, etc. Meanwhile after the fracking moratorium was announced, they still kept the pipeline route proposal as it was.

    Part of the reason there has not been MORE institutional (organizational, local councils etc) disapproval of the pipeline is that those people do understand the gas from Pennsylvania could be sold in part to local industry as it passes through, and its availability could be a draw for new industry to locate up here. On the other hand plenty of people look aghast at this sort of quid pro quo as a complete downer, because of the extra potential for disaster with a bunch of extra 10" lines that would get put in. This whole area is a watershed, the source of both the Delaware and Susquehanna river systems. There are creeks, streams, brooks, feeder rivers everywhere.

    I could never understand why they wouldn't just use the right of way along I-88 or a state road like 206, provided that THE IDEA WAS JUST TO TRANSPORT GAS FROM PENNSYLVANIA. First of all inspection would certainly be easier, likewise critical maintenance (which you gotta wonder about with the alternate route; how are they gonna get into these marshes and put the cleaning robots in during winter). Then I realized it was not about that, it was about fracking, about putting the line where the gas they wanted to frack would be taken up.

    But when you say that it's ultimately about piped NYS fracked gas, the consortium says no no it's just to move gas already being produced further south. Then we say yeah but you're going to sell it abroad. They say no, it's going to New England and you can buy some of it for local use if you want. And btw here's some goodies for your community. I mean they have dished out a lot of stuff. And we're broke counties so of course we took it.

    If you ask me it's just a big mess no matter which way it ends up going. If it's just transmission then there will definitely end up being more feeder lines because local communities will say hey it's going past here anyway so let's buy some. If it's expected that someday a Republican governor will replace Cuomo and fracking permits requests are renewed, and approved, then we're back to looking at all the mess of fracking gas from everywhere around here into the new pipeline, and maybe not the feeder lines, who knows. By the time they get to fracking, some of those new coastal terminals will be in biz, so if they can export the gas at a higher price than selling it to us local yokels, bet the ranch we will never see any of it. I hope DEC tells them to stick it. Let them revisit the drawing board and run their "transport" line along the interstate and state instead of digging up property they didn't get the right to frack in just because they think they'll get that right later on.

    Well I'm done thinking about this for tonight. Happy holidays are ahead for all of us, I hope. I keep saying my prep for it is mostly done but then I keep bumping into stuff that's not quite there.

    One could wonder whether Constitution consortium will be in such a rush to proceed with its pipeline extension.

    So another shoe drops: a “mystery” utility will apparently construct a Catskills power plant to take off some of the product from the proposed Northeast Energy Direct pipeline (unless of course the export price makes selling the gas in the USA a really dumb thing to do, now that Congress has eased some export restrictions among other gifts tucked into the 2000 pages of the budget bill it just put on the prez's desk).


    But... those who live in the area and know the history of the Marcy-South power transmission line think we know roughly where the new plant would go. On top of a nearby mountain.

    Meanwhile a bit of Hollywood star power has got behind protests of another power plant going up in New York State, down in Orange County nearer to NYC; 75-year-old actor James Cromwell has a residence in the area and was arrested while leading a protest on Friday morning. That site is already being graded for the construction.

    I’m a big fan of Cromwell... and if he can do this at his age, I’ve no excuse not to end up at the barricades when we find out where this latest fossil-fueled power plant is slated to go. No one sane thinks this is anything but an expectation of being able to use locally fracked gas later on when some other administration is governing New York State and the moratorium on fracking can be overturned.

    My guess the real agenda:
    Cons: argue that this pipeline extension and six others being built to traverse Pennsylvania and New York are basically being constructed with intent to export natural gas abroad from the east coast terminals that are now being planned or are in the permit-reqesting stage.

    Question from a supply and demand standpoint, foreign demand has what effect on local prices?

    An excellent idea. Let's build more clean nuclear power plants that do not require a massive pipeline infrastructure and emit zero greenhouse gases.

    I disagree. If you have every bit of development held up over an individual'd grievance, you'd have stagnation and eventually decay. While standing up is a valued aspect of American culture, it's balanced by society's need for growth and progress. "Getting used to it" brought us the life we enjoy today, and while we can all quibble and complain about aspects of it, we live in relative comfort and security.
