My iPhone when on silent requires the slightest touch for it to knock of silent, then because it hasnt locked in to position at loud goes back on silent causing it to vibrate, which is extremely annoying. Is there anyway i can fix this?

My wife's is doing the same. Last week I replaced my Home button on an iPhone 4 and this repair to a 3GS is also possible to do yourself if you feel confident enough, otherwise it's a replacement phone from Apple at cost.

Out of interest, does anybody know if Apple would replace a faulty 3GS at cost in the UK and if so, how much?
