I have an iPhone 5S on its way, but I want to sell my iPhone 5, but the BATTERY seems to be messed up!
Every day, my iPhone 5 just turns off at like 20% and it'll let me turn it on for a little bit and it'll turn back off again!

If I bought it to the apple store would they replace the phone if it has been under a year since I purchased it? I had the beta version of iOS 7, but I doubt that would prevent them from giving me a new one?

They will give you a new one. As long as it's still under original AppleCare they will replace it.

Question: I don't have applecare, but I have had it for under 1 year, is it still under warranty in that case?

As long as you bought it within the 1 year warranty window, you don't need Applecare to get a free replacement.
