IRS starts recognizing same-sex marriages

    I hope some gay people filing jointly for the first time are not shocked to be paying more in taxes then filing single. Welcome to the marriage penalty tax.

    I don't think it went back far enough retroactively.

    Case in point: Didn't Prop. 8 pass in 2008? If so, what about those marriages that were made prior to its passing? Wouldn't they still have to file single?

    The way I understand it is that if you were married in 2010-2012 (regardless of when you got married), you can go back and file an amendment - so basically, if you could've filed jointly in those years if your spouse was the opposite gender, you can get money back.

    With Federal recognition of SS marriage they had no choice.

    Or as I pointed pay more taxes under certain conditions.

    Not an issue. You don't have to refile and you surely won't if your tax liability is higher.
