Not Guilty

    Betty Shelby found not guilty of first-degree manslaughter in fatal shooting of unarmed black man


    Some people insist that the shooting was somehow motivated by race. Personally, I don't think race played a part. It was simply a person who has no business having a gun, let alone being a member of the police department, getting in a situation where she, flanked by several other police officers, was so afraid that her only instinct was to panic.

    The jury's verdict is puzzling to me. I would have thought that if you shoot an unarmed person and it is video'd, you are doing time.

    That's Oklahoma, I guess.

    the cop/murderer/CRIMINAL on your story happens to also be a female.

    Remember the Marine veteran-turned-cop who got fired because he was deescalating a suicidal situation instead of taking a shot?

    Sounds like she went the opposite direction and didn't have the steady nerves that this less-dangerous situation required.

    (along with a healthy dose of blaming the victim)

    In general, it's about the reasonable perception of danger.
    If someone is holding a banana 20 ft from you at night and then suddenly points it at you saying "I am going to shoot" you can defend yourself by shooting (as long as the banana wasn't really visible as a fruit).
    I am not sure this is the case.

    My guess is that there is a lot of variability in terms of what constitutes "reasonable perception of danger."

    pretty skewed area when it involves police.. far too easy for them to get away with it.

    I think there is a reason why cops get charged with murder instead of manslaughter. Murder rap is easy to beat because that charge requires premeditation, which is never going to be proven.

    We'd see a lot more convictions (of the few cases that actually go to court, anyway) if the charge itself was manslaughter.

    It's almost as if prosecutors are picking charges based on the knowledge that the cop will never meet the legal requirement and therefore gets a not guilty result...

    The disturbing part is that the cop who was pretty much walking alongside her had a Taser but did not use it. What's the point of having non-lethal weapons if cops elect to use the lethal ones instead?

    I think what it tells us is that one cop felt like at most, the situation required a taser. The other cop, well, has no business having access to any lethal weapons whatsoever.
