I just recently got my new 14 inch MBP M1 a week ago with Monterey version 12.3 already preinstalled on it.

I’m ready to update to Monterey version 12.6.

Since I have FileVault turned on, do I need to temporarily turn it off for the update?

The reason why I’m asking, because I don’t want the following error message appear as from the attached image.

I updated an M1 iMac to 12.6 with FileVault enabled. I survived without getting that message. It IS Monterey though, so your mileage may vary (but I suspect not by that much, if at all).

Just to confirm that I don’t have to temporarily turn off FileVault before upgrading to a newer versions of MacOS? Is this correct?

Correct. I turned on FileVault five years ago for my 2017 MBP (running High Sierra at the time), and have installed every single update since then without turning it off. Never had any issues.
