Unlock and a few ??

I just ordered the refurbished iphone from ATT and have a few questions
Is it possible to just unlock it where I can only use it as a phone, no data plan
Is there any unlocking software that is valid and will work with that phone 1.1.4

You do not need to have a data plan to use the iPhone on ANY network. Even ATT.
