US Supreme Court denies Arch Coal appeal of EPA's withdrawal of WV dredge/fill permit

    The Arch Coal project sought to dynamite 2200 acres of forest and mountain, which would fill in up to seven miles of local waterways in West Virginia. Original permit from the Army Corps of Engineers was withdrawn by EPA based on new data after work had begun. Arch Coal lost in appeals court 3-0 and went to the US Supreme Court, which has now let the appeals court ruling stand. Usual cast of characters had backed Arch Coal's bid for a hearing.
