    As a former customs officer, she's going to have a tough time with this case. Basically all the customs officers have to prove is probable cause, that's it. Now as far as the actions(and gender) of the doctor are concerned if they did/were going to perform an x-ray then why the manual cavity search?

    They might have violated CBP's own policies regarding her holding.

    However, in a similar case a New Mexico woman sued after similar treatment and received a $1.1 million settlement from the hospital, but the agency did not pay and the suit against the officers was dismissed in federal court just a few days ago.

    It doesn't matter if you've never crossed the border in your life. Federal law authorizes warrantless search and seizures within a "reasonable distance" of a national or coastal border.

    Personally I would interpret this as authorization at border crossings to look, for example, through people's bags for contraband, and that "reasonable distance" would be something like 500 yards or so from the point of entry to allow for border crossing infrastructure, and of course it would vary if needed for example a half mile line of cars or whatnot.

    But federal bureaucrats determined that the "reasonable distance" phrase in the law meant any public land within 100 miles of a national or coastal border. So warrantless search and seizure is authorized on any public land in the orange area in the following picture:

    By the way the same is authorized on private property up to 25 miles, but not including private dwellings.

    Source? Sounds wholly unconstitutional to me. If the suit filed by this woman is true, it is an awful abuse of power, both by the government and the medical staff involved.
