Apple has been forced to remove purchasing options for its iPhone 3GS, iPhone 4 and 3G iPad products from its website in Germany after Motorola secured an injunction against Apple’s 3G-capable devices at a Mannheim court.

No. No one wins at the game of patents and courts, except for the lawyers. And you know who loses the most ? The consumer.

This applies to all these players (Apple, Motorola, Samsung, Kodak, Nokia, RIM, Microsoft, etc...).

Those phones are still available in the retail stores. This only affects on-line purchases.

once again the consumer gets screwed.

Instead of wasting time and money "combatting piracy" the lawmakers in US and Europe should take the time and sort out the patent laws that are slowly destroying the mobile tech market. A lot of these patents are absolutely ridiculous and should have never been granted - including certain patents filed by Apple.

Apple loses patent lawsuit and withdraws hardware from german online store

After losing the patent lawsuit filed by Motorola late last year, Apple withdrew some of hardware from their own webstore. Currently this only affects the german store, but the patent in question is European.

The patent itself deals with synchronization of mobile devices through a cloud and has been filed in 2002.

The iPhone 3G, iPhone 3GS, iPhone 4 and the 3G iPad Versions have been removed from the store.

Indeed. Which makes it all the sadder that Apple appear to have been responsible for a massive escalation in this mess.

This could backfire on motorola in a major way. They've had these products banned on the basis of a FRAND patent. Those patents are covered by special rules, and they're supposed to license them fairly to anyone who needs them - if they didn't do that, the 3G networks wouldn't work, patent trolls would continuously pop up and demand money if you want to use your phone.

The EU is currently investigating samsung over abuse of FRAND patents, and there's a pretty high chance that motorola is going to get the same attention. If that happens the ban could be reversed and motorola could be fined heavily.

What's probably more worrying for apple: motorola won a different dispute this morning, one that covers iCloud. That's not a FRAND patent, and it covers anything that uses iCloud. It also targets apple's ireland distribution company, which could affect sales across europe.

What makes you think Apple didn't refuse Motorola's F/RAND terms ? You know, these lawyers have these things covered. It wouldn't be the first time Apple balks at F/RAND terms and gets dragged to court over it (remember Apple vs Nokia).
