On the left is Windows Mobile, a stylus & keyboard based OS. On the right is Android, a touch-based OS. Hmm, wonder why they would look so different?

Have you seen Android phone pre iPhone and post iPhone...

Google-Android-history-before-after-iPhone.jpg

Lets not forget that E.Schmidtt was let go from Apple's Board of Directors for basically stealing the iPhone design.

I can see Apple's point that the post-iPhone Samsung phones are identical to the iPhone's design, but these lawsuits are getting ridiculous and making Apple look bad in a lot of people's eyes. I don't get why Apple is focusing on Samsung so much, pretty much every smartphone out there now is an iPhone ripoff.

There were full screen touch phones before the iPhone and several already in production before the iPhone was even announced.

And if you don't understand why Apple is going after Samsung so much - then perhaps you shouldn't be commenting on these threads. Not to be mean - but it's blatantly obvious that Apple's biggest threat of competition is Samsung.

? did you look at the photo?

At some point, you have to protect your intellectual knowledge and what you've CREATED, not copied.

This goes for any company.

Only Apple isn't innocent of not copying or standing on the backs of others to produce the iPhone and other devices.

That's not gonna go far as an argument in light of Samsung's internal documents about the F700 design, it's 2006 design registration, and frankly, their entire brief :

Maybe Apple's lawyers should have familiarised themselves with this little nugget :

Seriously, do Apple's lawyers even read court briefs ? This is gonna be interesting.

Samsung are such blatant copycats. Go Apple!!! Just look at these for blatant copying:

And as if that's not enough:

EXACTLY!!

Windows Phone looks nothing like the iPhone so apparently there's more than one way to design a touch OS.

Uh ? When did this even happen ?

Because Rob Enderly pretended so ?

Eric resigned from Apple's board because he would recluse himself from meetings about iOS, the iPhone and the iPad. The problem was that these meetings became more and more prevalent.

Apple, Steve Jobs, no one ever accused Eric of anything. Only forum goers and Apple media shills do.

Got to give the lawyers credit but counter point is Samsung was really only making WinMobile smart phones before hand and that OS just was not really designed for a good touch interface.

I also seem the same heavily edited screens for samsung but what ever. This entire trial will be a joke and the lawyers trying to confuse the jury.

Not true about the touch interface, I had one of the win mobile touch screen phones and the touch screen actually functioned fine.

Just the OS really sucked(but that was all we had back then.)

Everyone's designs changed. Apple forgets that they call themselves "innovators". Don't innovators change the concept of products? Of course nobody is going to still design flip-phones.

A good test is say a car. Can you cover up the branding logo/ornament on a say BMW 3 sedan nd an say an Audi 4 sedan and tell the difference from a distance, even though they are both cars and in the same class segment?

I'd say 90%+ could easily distinguish due to differing 'design' elements and schemes.

Now do the same with the Samsung Galaxy (and other phones) and the iPhone....especially those that came right after the iPhone in that image.

That's Apples point.

Based on that graphic, HP should be all over apple for stealing from Palm.

That graphic is misrepresentative of the reality of the phone industry. Where's the P800, P900, where's the LG Prada, the Samsung F700 ?

Where's the Android prototype that was a full screen touch phone ? Where's the HTC Magic ?

True, but those companies did sue Apple and Apple had to pay. Don't understand why some hold Apple to a different standard regarding this.

1. your image leaves out a lot of phone models. Graphic fail.

2. No. He wasn't let go for stealing the iPhone design. Point fail.

1. I didn't make it. Fail on you.

2. Yes he was. Don't believe the 'nice' story that was put out there.

This is stupid...Apple wants to try to prove that had the iPhone not been around, we wouldn't have Androids like we do today?

You cannot prove an uncertainty.

I'm keeping my horse out of this race, but your image is an unfair comparison. You can't compare the iPhone's design to dumb phones' designs and point out there's a difference. While they were made by Samsung, they aren't in the same category of device which makes their existence here useless. It's almost like saying "Samsung released a dryer in 2009 that doesn't look like an iPhone, too!"

I don't. I hold them to the same standard. I also don't get emotionally involved with companies or my electronic devices.

I initially commented that the lawyers statement was a bit of a farce. The lawyer (and rightly so) wants to position Apple as an innovator with Samsung just copying. The truth is - both companies copied and both companies are innovators.

So much so - that it's a symbiotic relationship. Without Samsung's innovations - several parts used by Apple in their iDevices wouldn't exist.

Neither one of them is an innocent.

That photo seems like a good example of selective evidence. Hopefully the court will delve a little deeper than one picture of a handful of models.
