iPod Ipod constantly restarting

My 30gb 5.5g Ipod restarts almost every time I pick it up from inactivity and in the morning sometimes it wont turn on at all.

Does anyone know a fix for this or should I just RMA it.

Another thing, Can I just bring it to the apple store and get a new one or have them look at it ?

Just follow these 5 steps. I fixed a nano that was having this same problem with this method.

Yeah, my brother almost purchased a new nano for the same.. he just assumed that it was broken.
