So much for everyone that said the whole thing would be thrown out

"nearly $600 million in damages" That is huge, and like a previous poster said, I wonder how much of the thrown out amount will be restored.
It can still be thrown out.
The appeal hasn't been heard yet. ;)

Samsung is appealing this verdict. It's just a beginning of the unraveling of this case.

Maybe now people can stop implying that Samsung was forced to pay over a billion dollars. It's not the amount that's misleading (although now it is) but rather the implication that they either already had to pay or will be paying that amount.

By the way, if you want to accuse someone of being on Samsung payroll, accuse the jury. They couldn't did it worst in the damages awarding not splitting them by patent

I'm unclear if that's what they were ordered to do based on the enormous set of instructions/worksheets they had or if they did it on their own causing this "backfire."

But yes - when Koh and the Jury read the verdict - it was a HUGE WIN!! But now it's tin foil hat time...

FOSS Patents reports that judge Lucy Koh has struck nearly half of the $1 billion in damages awarded to Apple in its patent lawsuit against Samsung last August, calling for a new trial to set revised damage amounts for the affected portions of the judgment.Judge Koh agreed with Samsung's lawyers that the jury had erred in some of its damage calculations for the 14 affected Samsung products, meaning that a new trial must be held to determine what the damages should be for those devices.

FOSS Patents notes that Apple remains entitled to nearly $600 million in damages from the original judgement, as well as whatever a new jury decides the damages should be for the 14 devices included in the retrial, and interest. Apple is also seeking supplemental damages that have yet to be determined.

The new trial covering the 14 Samsung devices will likely not be heard until appeals of the original ruling have played out, meaning that is likely to be some time before any revised damages are decided.

That $450 million is the total amount the jury awarded for those 14 devices. But while the various devices were ruled by the jury to infringe various combinations of multiple patents, the jury only listed a single dollar amount for each one.

The judge ruling that the jury screwed up on the application of certain patent-device combinations, but she can't recalculate damages for those devices because the jury didn't break down how much each patent contributed to the total amount per device.

So she has to throw out the total amounts for those devices and have a new trial to allow a jury to decide that. Some or most of that $450 million may be restored by the new jury.

More is also possible.

Unfreaking real. That shoots innovators and designers in the head. Why try and improve anything when you know its going to be knocked off in Asia soon afterwards. And the legal system just lets it happen.

Corrupt, copying, plagiarizing, thieves. Samsung Korean, Koh Korean, how big a bag of cash did she get I wonder?

Oh how I hate Samsung. Phones, washers, dryers, microwaves, Audio, Video they knock it ALL off and profit from the design, research and hard work of others. Pathetic cowards.

The judge gives the clear orders to the jury and inspects the result before presenting it. If it wasn't sufficient for the judge, it would have been sent back to the Jury for completion. This is still the judges fault.

This is nothing more than judicial activism especially after a jury found that Samsung did indeed infringe on Apple's products. Absolutely depressing. :(

Wow. One can only shake their head in disbelief. Did Samsung ever try settling with Apple out of court? Just wondering. Samsung has always contended that they did nothing wrong so settling may be difficult. We all kmow Cook doesn't like this whole legal mess and would rather it all go away. Were there lawsuits when Jobs was around? I know there were threats, but drawn out legal battles?

It is really sad that people like you can imply corruption of one judge when you don't like was she has done.

You do realise the lawyers are not the product designers right? The product designers do their job, the lawyers do their job. Having court cases does not affect productivity.

This is why patents offer very little security. They are simply a license to sue, which explains how "patent trolls", or IP litigation specialists, more fairly, have popped up and become repositories for the vast majority of valuable IP.

The legal system works for lawyers, not citizens or parties. Needs fixin'.

exactly! If I were Apple and getting all my **** ripped off every product release. I don't care how much I love designing products I would start to think about stopping just because all my hard work gets ripped off and the thieving companies get away with it. Look at Samsung pulling in the cash from standing on the shoulders of Apple.

Sounds like the correct decision, to me. These details must be worked out--not her fault. So a new trial is needed to make up for the technical failings of the first decision. Too bad, maybe, but the law is complex.
