This is BAD for Google.


One of the most interesting passages in today's order quotes from an October 2005 email by Google's Android boss Andy Rubin back in 2005:

"If Sun doesn't want to work with us, we have two options: 1) Abandon our work and adopt MSFT CLR VM and C# language - or - 2) Do Java anyway and defend our decision, perhaps making enemies along the way"

If a jury sees that statement (and if there is a trial, then the jury will see it for sure), Google has a very serious problem. And "very serious" may be an understatement. Moreover, a statement like that showing up in publicly accessible court documents now may cause significant concern among many of Google's Android partners (including, but not limited to, device makers).

If anything this is bad news for iPhone...less competition = less intention for innovation
By the way isn't that what Apple had been doing for ages? Try to kill competitors by patent trolling.

Florian is a troll. Anyone reading his blog and taking anything said there as fact is nuts. Seriously, the guy has been wrong about 2000 times already about this case and he's been disproven at any turn.

This guy is a Microsoft schill and basically spreads FUD about any other company out there. :rolleyes:

When I saw the link to FOSS patents, I knew right away. The case is going very badly for Oracle right now, a few of their patents have been invalidated, their copyright claims have all been rejected and of the patents that remain, it is unclear whether Google even infringes them and if they do, Google has paperwork that states that Sun was willing to license everything to them for 100$ million, very far from the billion in damages Oracle seeks.

Whatever guys, nothing to see here, move along. Call us when someone other than Florian Mueller, someone with a shred of credibility, comments on the case.

Uh, if this is a smoking gun that if the jury sees will totally turn the case.... then why would it show up on some random forum before it showed up in court?

The email was presented to the JUDGE as one of the evidence against Google.

Love or hate Florian this evidence is pretty damning and self-explanatory.

We don't need a lawyer or a patent expert to explain to us the importance of this email.


It shows willful infringement on the part of Google, which will most likely TRIPLE the amount of damages Oracle can collect from Google.

I don't see how it shows willful infringement.

It shows they knew Sun wouldn't like it, but that's not the same thing.

Android is indeed in trouble.

Oracle is pushing from one side from the other Microsoft is muscling around manufacturers and demand royalties from them.

They are already have HTC, next they want Samsung and others, if they get their way Android could be in trouble because there simply won't be any profit to manufacturers and they'll look at MeeGo or Windows Phone.

Apple/MS/etc. haven't even used the Nortel patents against Google yet.

:rolleyes: Sure, post something from 2005 and look at how well Google is doing 6 years later. You think it has been bad news for them? Dude, seriously? Are you trying to tell us it will ruin Google?...lol

Oracle wants to prove that Google willingly and knowingly infringed on Java patents when they were developing Android.

this email is one of Oracle's biggest arsenal against Google.

Whatever, wake us up if anything EVER happens. Showing a 6 year old quote with no ramifications whatsoever at this point while Google continues to grow faster and faster by the day is weak. It isnt going to break them even if something finally does come from it.

What is your point of even posting this?

Google has already indicated that it was willing to pay and settle this case with Oracle.

If there's proof (and there are plenty) that Google willingly infringed on Java patents owned by Oracle, the amount of money Google will pay Oracle will TRIPLE. is that clear enough for you?

I posted this because a lot of people are following this case.
