10.7.2 Smart Folders still broken

I can't believe I can't find anything about this. Yes, 10.7.2 now saves my search criteria, but now it sporadically doesn't acknowledge it. Now when I check the criteria it can bring it up, but often my searches still bring up emails and crap that I don't want to browse.

Does Apple realize that it's still broken? Any workarounds?
