Delete and rotate options not always present

When looking at photos on my iPad on the top right-hand side of the photo sometimes delete and rotate options not always present. Why would I have those two options on some photos but not all of them?

You can only delete photos in your saved album. You cannot delete what you sync through iTunes. The other icon is an action button which brings up a menu. It's not for rotating.
