Has anyone tried osx 10.9 mavericks developer preview 4 to see if the 16gb compatibility issue is fixed?

Tried posting a new thread at apple.com but the fascist mods said it was "speculative" and deleted it.
 
As far as I know, the compatibility issue is a hardware one, not software. So you probably won't see a remedy even with Mavericks.
 
And yet, Apple did increase the usable RAM for late '08 MacBooks via EFI update:
“Secret” Firmware lets Late ’08 MacBooks use 8GB.

The limitation in the Late '08 MacBooks was a BIOS/firmware limitation. In other words, it was a software limitation rather than a hardware one. The hardware could always see the full 8GB, but software could only address up to about 6GB.

But the one in the 2010 MacBooks, as far as I know, is actually a hardware limitation.
