iPod 1G ipod battery dead..

My 1g 10 gb battery's life is nearly up.. thinking of getting it replaced.
Now here's the thing which ipod will i be getting as a replacement?
the same one (doubt if they still have them) ? will i get bumped up to the next best model ? Or will i get a 5g ipod?

Your 1G will not be replaced. NOt unless you guys have some odd law in India that says battery capacity can't deplete. You're best option is either to replace the battery yourself or at a service center, or (better option) buy a new 5G ipod.

Huh? Isn't that well out of warranty by now?
Most warranties exclude consumeable parts like batteries. Applecare excludes replaceable batteries specifically, but its debateable if the iPod battery was ever intended to be cosumer replaceable.

Anyway, US$40 or so gets you a new, higher capacity battery.

The iPod is well out of warranty. So i need to take it in to a Apple auth service provider..no apple shops here, but as iGary pointed out i should get a "new (refurbished) 1G iPod in exchange via mail." after the 59$ payment ofcourse.

Now does Apple stilll carry 1g refurbs? if they do great ! loved my 1g !

If they dont here's the question ? Am i going to get bumped up to the next best refurb maybe a 15gb 3g iPod or is Apple's policy such that i get their new 5g ..

No, I would say no chance on earth you will get a 3G or a 5G

So your saying no chance with a 3g or 5g . Does that mean Apple still has 1g 10gb ipod refurbs stocked up somewhere ? In India apple do not open up iPods . If there is a problem any problem whatsoever the iPod is replaced with a refurb.
