It's not new, it's refurbished.

On the website they say "open box" and "remainder of apple 1 year warranty"
 
Ad is misleading.

1. Doesn't say if it's unlocked or locked
2. Claims $799 retail pricing. Duh. Retail is $650 for 16gb unlocked in USA brand new

I think misleading, as some one else said, is more accurate.

I have ordered a few things from them and have always had a good experience.

Sounds like the ad is just too vague. The wrong price, on the other hand, is just some ones screw up.
