iPod touch 1st Gen apple screen

i just got the ipod touch 1st gen
if i dont use anything on it for 2-3 min, it goes to the white apple on the screen and flashes from time to time. now the only way i can get it back to normal, is by pluging in the usb cable (doesn't matter if its in a computer or just a power outlet) and after a few sec, comes back to the main screen or the locked screen, but its fine after that. (untill i leave it alone for a few, then goes back to the apple screen)

any help??

Is it jailbroken? I would try a restore if you haven't already.

i just got it, but i don't think its jailbroken, i updated the software on it a few days ago, thinking it might solve my problem.
that didn't work
tried to restore it, didn't work
as long as something is happenning in the background it wont "stall" or "freez"

if nothing is happenning, and i let it be for 30 sec or so, it seems like it wants to shutdown or something and freezez in the prosses
