3.1.3 update smart playlist disappears

I just did the 313 update and my smart playlist dissappeared. I deleted and resync'd, rebooted the iphone, iphone itunes recataloged the music, and when I sync the iphone the smart playlist shows in the music list but does not appear on the device.

is anyone else struggling with this?
