Let's say I just purchased a new iPhone 4 16GB at the $199 upgrade price and want to get out of my ATT plan (and pay the $375 ETF fee), is it true that I have to wait 30 days before I can do this and essentially pay for a month's worth of minutes / data ?

Yes, otherwise you have to give the iPhone back. It would have been about the same price to just buy the phone unsubsidized.
 
I wonder if you are brand new to AT&T because of the iPhone 4 and are not happy with the phone and want to cancel. Would I still have to pay the termination fee?
