That's because its so new and so many people at once purchased the phones. Heck, apple sold one million iPhones in a weekend. There's bound to be those that have defective units, or units that don't quite live up to expectation.
The iPhone 3GS has a lot going for it but it may not be the right phone for you, check out the features and determine of those features are worth the upgrade. For me it was because I wanted a faster unit, more memory, and the ability to shoot video.
