well I dont know if I was the only one still having an inactive summerboard but I managed to find a fix on the ipod touch fans forum
only do this if you know what you are doing
ftp or ssh into your touch
go to the root foler where applications folder is then go to: System/Library/CoreServices/Springboard.app
scroll down to a file called springboard and change the chmod to 755 and reboot your ipod touch go back to summerboard and it should now say active
