My 5s the top left hand corner when in a case pops out. It seems that it is to small to fit.

Let me get this straight, you think that your iPhone is too small rather than just that the case you got is too large...?

Test it on someone else's iPhone 5 and see if the same thing happens. I've never heard of someone getting an iPhone that's too small before. :p
 
Yes, a $650+ product manufactured by a multibillion dollar company is faulty. Whereas, a $10 case is not..
 
More details on the case would help, since as others have stated, it is most likely the item that's screwed up here and not your iPhone.

All of them of the same model are made on the same assembly lines of the same parts that have to meet certain very exact specifications, so the odds are completely against one being smaller than the others, we're likely talking millions to one.

The case was likely mis-sized, or it's misshapen.

Have you thought about putting some gum or glue between the case and the "too small" iPhone.

I tried it on an apple case and an incipio case. Both same results

What cases exactly? There is virtually no chance your iPhone is too small for the case, are these cases you have used before and possibly stretched? Are they cases meant for the 5S? The cases for the 5 should fit fine but if it is a 5C case then you are going to have problems.
 
not its not the 5c case and it is from a 5 case but the apple leather case is having the same issue

As someone who owns an MBP, iPad Mini, Apple TV AND IPHONE 5, he's not that ill-informed. ;)
