can you still get a 5th gen touch with ios 6.1.2 or lower at bestbuy or walmart? or is there a way to tell the os version from the serial number?

Probably depends on how old the store's stock is.
I picked up a Touch this morning and asked if it was iOS 7. Clerk told me yes, which was perfectly fine because I upgraded my own Touch 5 to iOS 7 and really like it.

Any specific reason you want it on iOS 6.1.2? Jailbreaking, perhaps? I got my girlfriend a 5th gen a week after iOS 7 was released, had iOS 6 on it, instantly installed iOS 7, and it runs it really, really well!
