My early 2013 mbp retina, i never updated to mac os. So if i buy a 2016 with mac os can i still use time machine to put back all my stuff( bookmarks, software , etc) or do i have to first up my 2013 to mac os for that to happen? Thx
 
You should be able to migrate from Mountain Lion (if that's what it's running) to Sierra. There may be applications that won't work in Sierra. MS Office 2011 (if installed) will require the product code to be re-entered.

Best to do the migration in a wired manner.
