Acasis TB401E says Mode Thunderbolt 3 Need Help

In System Info the External ACASIS TB401E housing with a WD Black SN770 1TB NVME SAYS THUNDERBOLT 3 MODE ON / MACMINI M4 PRO / MacOs 15.2

I have the drive plugged into the back TB ports to the best of my knowledge these ports are TB5 ports so a USB4 / 40GBs speed housing should be at least TB4 the Drive says it can handle up to 5150 speeds but I am only getting 2700 / 2800 read write

I have my Home Folder on this drive

Do I need to get a different enclosure?

If you look at the Acasis site these numbers are inline with the specs and are expected.
