Hey all on Thursday the 14th January my house-mate was shocked when she opened a letter from ACS:Law regarding copyright infringement acting on behalf of a company called DigiProtect along with a letter from the high court of justice and asking for a cost of £500 which would be a out of court settlement if refused to pay they would take us to court and it would cost up to £7000. That was the 1st initial shock for us the second was in the nature in what we were accused of downloading which was pornographic film which caused a very big argument and upset with my self and my house mate being as they are in there late 40's and I'm only 22 and the main internet user in the house so as you may guess the blame had landed on me at 1st. In the letter it is said that we had used a peer to peer site called Bittorrent to obtain this film the letter also gave a supposed host IP address and a IP address along with a previous internet provider we were using which was BT but in november 08 i took over paying for the internet and phone line and move it to virgin media. The date and time when the download was made supposedly made which was back in 21/06/08 since we had this letter it has made things very stressful and has caused a loss of sleep for the 1st 2 nights after the letter was received. I have been in contact with are former internet provider which as i mentioned before was BT which were no help the only information they provided me with was a address to wright to only they would be able to help and provide some information and that in the letter i should give the times and date mentioned in the letter from ACS:Law and the host IP number and IP number that was supposedly use when the incident happened. After contacting may different law advise company's and government help call centres who seemed like they didn't want to touch the situation but have herd of ACS:LAW before. I have also spoken to solicitors who deal in copyright law they have asked for a copy of both of the letters to be sent to them so that they could look it over and give me advise but after that they will have to charge me with a fee of £250 per hour. I have contacted ACS:Law direct the person i spoke to was very rude and cocky on the matter in hand and when i asked for them to provide more evidence that would prove us to be the offender the person said that i didn't need any other evidence to be shown that we had made this offense other than what was presented in the letter if i wasn't happy i could take it to a court. I contacted Solicitors Regulation Authority who have said they are building a case up on ACS but couldn't help me individually. I have been advised to possibly contact the BBC or a local news paper or radio to see if they would bring this matter into light i don't know where to turn to its becoming very stressful and the amount of hours i have spent reading different thread's in forums and news articles etc which go back 3 years ago but they don't really give much info in what to do apart from 2 or 3 sites that help and give advise. Sorry if this rant has gone on a bit but i needed to vent some of my frustration and to see if there is anyone who has been unfortunate to have been contacted by this law firm and what they have done about this???.

Thanks for the response Rodus i've already been on beingthreatened.com there were a lot of help but as for slyck.com never herd or seen that site thanks for the mention.
 
Whatever you do don't give them any money!!

A few years ago the same scheme was being carried out by law firm Davenport Lyons, until BBC Watchdog got involved. Now ACS:Law seem to have taken over. Don't let them intimidate or threaten you. None of their cases have ever gone to court, except those where the person accused actually had committed the offense and admitted to it. Their evidence will definitely not hold up. You're innocent, so don't let them take advantage of you.

Unfortunately so many people get intimidated by them and actually pay up, even though they know they didn't commit the offense, that it's easy money for ACS:Law. Read through the forums on BeingThreatened and follow their advice, and you'll be fine. Definitely send some sort of letter or email to BBC Watchdog, the more people who do the sooner it will be stopped.
 
Deny everything in writing, repeatedly if they keep writing back. Tell them to leave you alone or take you to court. They won't go the court route as an IP is not enough evidence. Do not pay them anything. They are simply chancing that you'll be scared into coughing up the cash, they will eventually back down if you fight back. Davenport Lyons and ACS really need putting on a leash with all this speculative invoicing. They're already tried to get cash from OAP's and a dead man! So as you can tell their evidence is really great.

Yeah were not going to pay anything and are in the process or writhing a letter to them we have also contacted BBC Watchdog and Lord Lucas who's against ACS.

I got the letter in jan at 1st panic and all the other bollocks that follows but i just need to say don’t panic and start wrighting your letter of defence a template can be found on these sites Below.

thanks for replying. ii was crapping my pants. but seems there has been loads sent out. i know i did nt download it. its well embarrassing the title of the porno they said i downloaded. hav they got back to.
 
So have you heard back from them since your first denial letter OP?


So far I’ve heard **** all i don't expect to there bully's once you tell them to piss off and they know there not going to get anything from me apart from my middle finger.

steve12345 - Yeah the title of the film i was accused of was pretty bad but i had to giggle when i looked it up tho :)
 
^^If you send just the template you'll probably just have a response saying they don't accept template letters so it's worth changing it a bit. If you guys have been hit for the porn downloads then it's probably Digiprotect involved as they bought the rights to distribute these movies online. Of course it's highly illegal to distribute these films (as they are on p2p) in the UK without an R18 certificate so they are breaking the law by doing it.
