Want to get out of this AT&T crap. If I cannot find a way to get out of the ETF, I will sell the 4S to cover it. Not ideal, as I would rather use that money to get a 32GB iPod Touch, but oh well.

So, any recent changes to the contract? Maybe... Throttling? Think that counts?

Try This:

(1) Stream NetFlix via 3G 24-hours per day.

(2) AT&T should cancel your contract and waive ETF.

(3) Keep your cell phone that AT&T helped you to pay for and use Skype instead.

NOT even then as 1 they never promised a speed and it does not negatively effect you.
 
Try and find a Tmobile or other gsm tower in an area that AT&T doesn't have service (only roaming agreements). Use 50% or more of your minutes while roaming from 3 consecutive months. That should take care of it. I think you can also call AT&T and have tem change the carrier logo, so that it shows when your roaming on domestic carriers. I'm not positive of that though.
 
Also, I think I read on some other post a few weeks ago that a guy successfully cancelled without paying the ETF.

He had to call about 4-5 times until he got a nice rep willing to do it.

Speed wasn't the issue as much as data consumption.
