Copyrights don't apply (they are for things like books and movies, ei, works that are distributed through copies, hence the term, copyright: the right to copy). This is a trade dress issue, which may not be actionable if its not released in the US. Apple killed numerous iMac look alikes when it first came out.

Shady at best, but if it's not coming to the US then I don't know if Apple can do anything about it. Case and point, it will still run Windows
