Aperture 3 - Do Not Constrain

Whenever I use the crop tool in Aperture 3, it seems to choose the aspect ration randomly. I usually prefer to use the 'Do not constrain' setting and want to be able to have that ready everytime I open up the crop tool. It's just a tad annoying that everytime I go to edit a photo with the crop tool, even in the same batch of photos, each time it seems to change the aspect ratio and I have to go in and change it back again.

Can this be done so it's always on 'Do not constrain'?

I have mine set on 'do not constrain', it just remembers your last setting afaik?

Do you have Aperture updated? I think 3.0 didn't remember but now in 3.0.3, it does.
